Achieve Test Prep User Terms & Conditions

Achieve Test Prep and its subsidiary company, Smarter with Achieve, are test prep companies that offer Programs intended to prepare you to pass third-party, standardized exams, including but not limited to CLEP, DSST and UExcel, which allow you to “test out” of certain college-level classes, provided that the accredited institution which you attend accepts such exams as the basis for awarding credit. This is commonly referred to as credit-by-exam. Your purchase, enrollment in and use of products and services ("Programs") offered by ATP, including your access to achievetestprep.com and respective subdomains (the “Site(s)”), are subject to these terms and conditions (“Terms”). If You purchase or enroll in a Program for use by another (for example, a parent purchasing for a child) these Terms govern both You and other(s) who use any Program you purchase (collectively, “You”). You agree to be bound by the Terms, which is an agreement between ATP and You, the customer.

ATP is Not a College

You acknowledge and agree that ATP is not a college, university, school, or institution of higher learning, nor does it represent any college, university or institution of higher learning. ATP does not award college credit, diplomas or degrees, and ATP cannot guarantee that the institution which you attend will allow you to “test out” of certain subjects or that those subjects which you test out of will satisfy such institution’s requirements for completing your degree. The role of ATP is to provide test preparation Programs for standardized examinations only. In order for you to receive college credit or a degree, you must enroll in an accredited college or university.

Testing Disclosure

Exams for credit are administered through independent testing agencies. You are responsible for exam fees and scheduling exams with the independent testing site. ATP has no control over the testing centers, testing requirements, fees, or restrictions.

Program Fees

With your purchase, you assume responsibility for the entire cost of the Programs purchased, whether or not you choose to participate in or utilize them. Once purchased, you cannot cancel unless by these Terms.

Exam Fees

Exam fees are paid directly to the testing centers and are separate from ATP’s Program fees. Most fees are around $100, but can be more than $400 depending on the exam. Contact Customer Success for current prices on your exams. ATP will reimburse exam fees of up to $150 once for each completed course provided that all terms below are met:

  • You must have completed at least 85% of all assignments that were assigned by the instructor for the related prep course.
  • You attended at least 85% of the scheduled lessons for the related prep course.
  • You have paid at least $500 toward your purchased Programs.

Your Right to Cancel

You have the right to cancel your Program until 24 hours after purchase. Written notice must be received by ATP within the specified cancellation period to be valid. After the 24-hour cancellation period, cancellation of your Programs with ATP is not available except as defined by the Cancellation/Refund Policy.

Cancellation/Refund Policy

After 24-hours of purchase, you are committing to:

  • Register and pay for at least one product; and
  • Pay for all product(s) or resources of which you have started or completed, plus 30% of the total cost of your Program prior to any discounts or grants. Contact our Customer Success team for the exact amount.

To be eligible for a refund, you must meet the following:

  • Participate in at least 85% of the course by attending sessions and completing course resources by the time of request.
  • Be within one year of your original program start date.

You may stop future automatic payments once your payment obligations have been fulfilled. To do so, you must make a written request to our customer success team. Once ATP has received written notification of its termination from the responsible party, autopay will be disabled within 30 days

Refunding On-Demand Tutoring

If you are unable to get accepted into a college nursing or dental hygienist program, we will refund the cost of your On-Demand Tutoring. You must meet the following guidelines:

  1. Complete all of the Credit-by-Examination courses in this agreement
  2. Complete all additional prerequisites required by the school as part of the application process for your major
  3. Complete the applicable required entrance exam and earn the required minimum score associated with the school
  4. Submit a complete application for your major as required by the school
  5. Submit proof of meeting the aforementioned requirements and your rejection letter to Achieve within 90 days of your rejection.

Cancellation Agreement Requirement

 In the event that a cancellation, refund, tuition adjustment, or account resolution is approved or processed, Achieve Test Prep requires the customer to execute a formal Cancellation Agreement outlining the final terms of such resolution, including but not limited to any balance due, refund amount, or tuition adjustment.

The customer agrees that execution of this Cancellation Agreement is a mandatory condition to finalize any cancellation, refund, or adjustment request.

Failure or refusal to sign the Cancellation Agreement does not invalidate the terms of this Agreement or the calculated financial obligations.

Tutoring Policy

Customers actively enrolled in Achieve Test Prep (ATP) courses may request one-on-one tutoring for specific topics if they need additional help or have failed an exam. Tutoring is available by appointment only and can be scheduled by contacting the customer’s education advisor. Sessions are scheduled on a first-come, first-served basis, with appointments offered within 7 days of the request. Tutoring is designed to supplement, not replace, the full Prep Course. Customers struggling with the course as a whole may need to retake it. If a customer cannot attend a session, they must notify ATP in advance. Failure to cancel or a “no-show” may result in ineligibility for future sessions. If the instructor cancels, the customer will be notified via email, phone, or text. Tutoring is available for all ATP Prep Courses.

Pass Assurance Policy

At Achieve Test Prep, we are committed to supporting your success. While we cannot guarantee a passing score on your exam, we offer valuable resources to help you improve and prepare. If you don’t pass your exam, you can retake your exam prep course at no additional cost. Additionally, we provide refresher materials and offer 1:1 tutoring to give you the extra support you need, all included as part of your program.

Test Score Publication Policy

Achieve Test Prep may publish customer test scores when available. Test scores are obtained either through customer submission via the customer portal or directly from the CLEP testing center. Customers may choose to have their individual test scores sent to Achieve by selecting Achieve Test Prep as a recipient during the CLEP exam registration process.

Credit Transfer Verification and Data Substantiation

At Achieve Test Prep, we prioritize providing accurate and reliable information to help you make informed decisions about your educational journey. Credit transfer policies are obtained either through the college's official website or by contacting the registrar's office directly to ensure the information is up-to-date and accurate.

Validate Your Credit Options

We’ll work with you to research your college’s CLEP and DSST policies, ensuring you understand your test-out options and can maximize your credit-by-exam opportunities before registering for an Achieve online test prep course.

Shared Use Prohibited

ATP agrees to provide purchased Programs for your sole use and benefit. You agree that any ATP study guides, course training, training methods and methodologies, or other non-public information obtained in connection with your Programs, are strictly confidential and you shall not sell, transfer, or assign to any other person, or allow any other person to use, or distribute in any method including the internet, any of these items.

College Bridge Plan (“Plan”)

The Customer acknowledges that ATP's educational recommendations, College of Interest, Program of Interest, academic pathway, and course package are based upon the information provided by the Customer at the time of enrollment and are material components of the Program purchased. Changes to educational goals, intended institutions, degree programs, career objectives, or other information provided after enrollment do not automatically entitle the Customer to modifications, course removals, refunds, tuition adjustments, or reductions in financial obligations.

Requests to modify a College of Interest, Program of Interest, academic pathway, or course package may be subject to transcript review, academic review, account standing, program participation, payment history, management approval, administrative fees, or other requirements established by ATP.

ATP reserves the right to approve, deny, postpone, or condition any requested modification. Courses included within the original enrollment package may not be removed solely based upon customer preference.

Access to Programs

As long as your payments are paid as scheduled, you will have access to your Programs during the 70 days allotted for each course you contracted for. For example, a customer that is contracted for 6 courses would have a maximum of 420 days (70 days x 6 courses) to complete their courses. However, if any of the courses are exit exam prep courses they will be excluded from this calculation. After this period of time has elapsed, you will not be permitted to attend any further course lessons and all courses will be deemed completed regardless if you have taken the corresponding lessons, however you are still bound by the payment terms of this Agreement. If you have extenuating circumstances and need more time to complete your courses, this may be granted. In this case, submit a written request to Customer Success for an extension of time, which may, or may not, be granted at the discretion of ATP.

Exit Exam Clause (Applicable to Nursing and Dental Students)

Exit exams such as the NCLEX (for nursing) and NBDHE or equivalent (for dental programs) are not subject to the course completion limitation outlined in this Agreement. Specifically:

  1. These exams are excluded from the calculation of your course completion timeline.
  2. You may take your exit exam at any time, regardless of whether your contracted course access period has ended.
  3. While your access to Achieve prep materials is governed by standard course timelines and payment terms, your ability to sit for your exit exam is not restricted by those timelines.

Course Extension Fees

In the event that additional time is required to complete a course, students may request a course extension. The following fees will apply:

  1. Monthly Extension Fee: A fee may be charged for each month of extended access. 
  2. Annual Extension Fee: A one-time payment may be granted an additional 12 months of access to the course.

All extension requests must be submitted in writing and approved by Achieve Test Prep. Extension fees are non-refundable and must be paid before the extension is granted.

Transcripts Submission for Course Modification:

We agree to submit official transcripts to Achieve Test Prep within 15 days following the enrollment date in order to initiate any requested modification of courses. Failure to submit the required transcripts within this timeframe will result in the inability to process or approve course modifications. Any modifications made after this period will be subject to institutional policies and may require additional approval or review.

Attending Multiple Courses

Your success is very much tied to taking and passing the exams shortly after completing each course with ATP. To ensure new customers start well, ATP does not allow new customers to register for more than two (2) courses simultaneously until at least one of the corresponding exams is taken and a result is reported.

Course Retakes and Supplementary Guidance

If you don’t pass an exam on the first try, you may retake a prep course free of charge provided that your Program remains active until passing the related exam. ATP also offers additional guidance and resources. If needed, ATP will offer additional guidance and resources upon request to aid your preparation. It's important to note that accessing any part of the supplementary guidance or resources is considered one course per subject.

Unregistering from a Course

Once you have registered for any course, you can unregister up to 48 hours prior to the course start date and time. Once the 48 hour period has passed, you may be assessed a $50 late unregistration fee, and the course will be considered taken. You can re-register for the course as a retake in the future. Failure to attend a course for which you have registered will not constitute unregistration. If you have received the study guide, accessed course resources, or attended any portion of the online course, this constitutes participation in the course and the course will be considered taken even if you have unregistered within the 48 hour period.

Course Cancellation by ATP

ATP reserves the right to cancel or postpone courses or course lessons at any time due to low enrollment or any event beyond ATP’s control. If this should happen, ATP will reschedule the course or course lesson as soon as conditions permit. ATP canceling a course or course lesson is not grounds for you terminating this Agreement or canceling your Programs.

Payments and Fees

Payment for your Program can be made via check, credit card, money order, or cashier's check. Please note that convenience fees may apply. Any adjustments to your plan may result in additional fees. ATP or its assigns will manage the collection of payments until your Program is considered fully paid.

Fees may be assessed for, but not limited to, payment processing, schedule changes, dropped courses, modifications to this agreement, late payments, or returned transactions. All fees are non-refundable and subject to change at the sole discretion of Achieve Test Prep.

Payment Default

You are responsible for making all payments due under this Agreement. Failure to make scheduled payments does not cancel your financial obligation and will not be considered a cancellation or withdrawal from the Program. Unless you formally withdraw in accordance with ATP’s Withdrawal Policy, you remain responsible for the full contract amount.

Any of the following will constitute a payment default:

  • Any payment is more than 30 days past due;
  • Accumulation of more than three late payments, where each is at least 10 days late;
  • A chargeback, ACH return for non-sufficient funds (NSF), or other payment reversal or failure.

In the event of a chargeback or ACH return, your account will be placed in a collection status and the entire remaining contract balance will become due immediately.

It is further understood that “monies due” may include amounts beyond the original contract total, such as late fees, manual processing charges, returned payment fees, or chargeback penalties.

ATP is not restricted by any time limits in exercising its rights in the event of a payment default. Even if your account is later brought current, ATP reserves the right to enforce collection or legal remedies at any time following a default.

Collection Costs

If your account is referred to a third-party collection agency or attorney due to non-payment, you agree to pay all reasonable costs of collection incurred by Achieve Test Prep or its assigns. These costs may include, without limitation, collection agency fees, court costs, private process server fees, investigation fees, and reasonable attorneys’ fees, and will be assessed to the fullest extent permitted by applicable law. Such charges are in addition to the remaining contract balance owed. Achieve Test Prep reserves the right to recover these costs without waiving any other rights or remedies available under this Agreement or by law.

Your total investment is $xxxx.xx more, or xx% annually, than if you paid in full with a discount at time of purchase. You are authorizing Achieve to debit your account for the recurring payment amount. If you decide you no longer want to use auto pay, You need to notify Achieve in writing at least 14 days before the next scheduled debit date.

I authorize Achieve to do a soft credit pull that will not affect my credit score and will provide me with additional financial options.

Business Hours and Communication Guidelines

By entering into this agreement, the undersigned acknowledges and agrees that Achieve Test Prep operates in the Eastern Standard Time (EST) zone. All communications related to this agreement—including inquiries, responses, and other interactions—will occur within our stated business hours: Monday through Friday, 10:00 AM to 7:00 PM EST.

Customers located in other time zones should be mindful of the time difference when reaching out to ensure timely responses. While we make every effort to respond promptly, messages received outside of business hours may experience delays.

As part of our standard process, we also strive to contact customers during their preferred hours whenever possible, based on the information provided to us.

Transfer and Assignment

ATP reserves the right, which is hereby granted by you, to transfer any or all of ATP’s right, title and interest in and to this Agreement and/or your purchased Programs (including all financial documents associated therewith) at its sole discretion to any individual, group, company or entity of its choosing.

Minors

People under the age of 18 (“Minors”) are not permitted to purchase or enroll in Programs. Minors may provide information to ATP and participate in Programs only with consent of a parent or guardian.

Choice of Law and Forum

The laws of the State of New Jersey shall govern the construction and interpretation of this Agreement. The Parties acknowledge and agree that this Agreement contains a binding arbitration clause. However, for any dispute with respect to this Agreement which arbitration is prohibited by federal or state law, the Parties hereto consent and submit to the personal jurisdiction and venue of a state or federal court of competent jurisdiction in Morris County, New Jersey (and of the appropriate appellate courts) in any action or proceeding with respect to such dispute.

Arbitration

Except as set forth in the paragraph above, any claim or dispute against ATP, whether related to this Agreement or otherwise, and any claim or dispute related to this Agreement or the relationship or duties contemplated under this agreement, including the validity of this arbitration clause, shall be resolved by binding arbitration. Arbitration must be initiated by the customer and will be administered by JAMS Arbitration ( https://www.jamsadr.com/) or, in the event JAMS Arbitration is unavailable to handle the matter within 30 days, another approved certified arbitration service that is mutually agreed upon in advance by both parties. Any award of the arbitrator(s) may be entered as a judgment in any court of competent jurisdiction.

Class Action Lawsuit Limitation

You agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted on an individual basis only and not in a class or representative action or as a named or unnamed member in a class, consolidated, representative or private attorney general action, unless both you and ATP specifically agree to do so in writing following the initiation of the arbitration.

Licensure Requirements

ATP is not responsible for changes in any state licensure requirements (such as state board of nursing) and/or interpretations of laws, statutes and policies made by governing bodies. Such changes do not alter your contractual obligations pursuant to this Agreement, including but not limited to your obligation to pay for your Programs.

Severability

If any provision of this Agreement is declared to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

NCLEX Testing Disclosure

(applicable only for nursing students) You understand that there are some states that may place additional requirements or restrictions that will affect your ability to work as an RN in that state. In some cases, you might be required to sit for your NCLEX in a neighboring state, and then transfer your license to your state of choice. It is your responsibility to be familiar with and comply with any requirements or restrictions in each state you wish to work as an RN, and ATP shall not be responsible for your failure to do so.

Travel Disclosure

Some of the colleges and universities may have some clinical components that require travel and the travel costs are not covered by the ATP fees.

Exceptions

There are no other agreements or conditions other than what this Agreement outlines. Any exceptions to this Agreement require written authorization from the ATP Executive Committee. This Agreement cannot be assigned by you without the prior written consent of ATP. This Agreement cannot be amended unless in writing, signed by all parties or their successors or assigns.

Customer Conduct and Right to Refuse Service

Achieve Test Prep is committed to maintaining a professional, respectful, and safe environment for its employees and customers.

Achieve Test Prep reserves the right, at its sole discretion, to refuse service, suspend access to Programs, or terminate this Agreement in the event of inappropriate, abusive, threatening, or harassing behavior toward staff, contractors, or representatives. This includes, but is not limited to, repeated use of offensive language, intimidation, refusal to engage in good faith resolution efforts, or any conduct that disrupts normal business operations.

In such cases, Achieve Test Prep may immediately restrict access to services and proceed with account closure or enforcement of financial obligations in accordance with this Agreement.

Termination or suspension of services under this clause does not relieve the customer of any financial obligations owed under this Agreement

Understanding

Clicking that you agree with these Terms signifies that you have read, understood and agreed to the Terms of this Agreement and that the cancellation policy has been clearly explained to you. THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION, WHICH MAY BE ENFORCED BY THE PARTIES.
